Terms of Service

These terms are an agreement between you and Haute Shots covering your use of hauteshotspodcast.com and its related subdomains. By using the site or submitting anything through it, you agree to them. If you do not agree, please do not use the site.

Our Privacy Policy explains how we handle information and forms part of these terms.

You may browse the site, share links to it, and contact us through it. You agree not to:

• Scrape, harvest, or bulk-download content, or use automated tools to access the site in a way that burdens it
• Attempt to breach, probe, or circumvent the site's security or access areas not intended for you
• Submit false information, impersonate anyone, or send unlawful, infringing, or abusive material through our forms
• Use the site or its content to train machine learning models without our written permission
• Use the site for any unlawful purpose

The photography, video, podcast episodes, articles, graphics, brand name, and logo on this site are owned by Haute Shots or used with permission, and are protected by copyright and trademark law.

You may not copy, reproduce, republish, resell, or redistribute our photography or video, or use it in advertising, without written permission. Linking to a page, or sharing a post through a platform's own share function, is always fine.

If you were photographed or featured by us and want to use an image commercially, email Isaac@hauteshotspodcast.com — we license our work and usually say yes.

Our forms let you send us collaboration inquiries and pitch a product or brand for the magazine. A few things you should know before you submit:

• Submissions are not confidential. Do not send trade secrets, unreleased information you need kept private, or anything under embargo without arranging that with us first.
• We are under no obligation to publish. Sending a submission does not create a business relationship, guarantee coverage, or entitle you to a response.
• You keep ownership of what you send. You grant us a non-exclusive, royalty-free licence to review it and, if we choose to feature you, to use the materials and information you provided in our editorial coverage across the site, podcast, magazine, and social channels.
• You need the rights to it.By submitting, you confirm the material is yours to send and that it does not infringe anyone else's rights.

Editorial decisions are ours alone. Coverage is not for sale, and a submission is not an advertisement.

Nothing on this site is an offer or a binding quote. Event coverage, shoots, and other paid work are governed by a separate written agreement covering scope, fees, deliverables, usage rights, and scheduling. Where that agreement conflicts with these terms, that agreement controls for that engagement.

The site links to and embeds third-party services, including YouTube, Spotify, Apple Podcasts, Instagram, TikTok, and Facebook. We do not control them and are not responsible for their content, availability, or practices. Your use of those services is governed by their terms.

The site and its content are provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components, or that the information on it is complete or current. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this may not apply to you.

To the fullest extent permitted by law, Haute Shots and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of the site — even if we were advised such damages were possible. Our total liability for any claim relating to the site is limited to one hundred U.S. dollars ($100) or the amount you paid us in the twelve months before the claim, whichever is greater. Some jurisdictions do not allow these limitations, so they may not fully apply to you.

You agree to indemnify and hold harmless Haute Shotsand its team from any claim, loss, or expense (including reasonable legal fees) arising out of your use of the site, anything you submit through it, or your breach of these terms or of someone else's rights.

These terms are governed by the laws of the State of Arizona, United States, without regard to its conflict-of-laws rules. Any dispute arising from these terms or the site will be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to their jurisdiction. Before filing anything, please email us — nearly everything is faster to resolve directly.

We may update these terms as the business changes. The revision date at the top reflects the current version, and continuing to use the site after an update means you accept it. We may also modify or discontinue any part of the site at any time.
